Introduction 

The Council for Native Hawaiian Advancement’s ("CNHA" or "We") respect your privacy and are committed to protecting it through our compliance with this policy. 

This policy describes CNHA’s policy concerning its practices for collecting, using, maintaining, protecting, and disclosing information concerning your visit to or use of the Helping Maui and Kako‘o Maui (“Program”) websites, helpingmaui.org and kakoomaui.com (the "Website"). 

This policy applies to both personally identifiable information and other information, as specified herein, and includes information: 

  • You submit through this Website; 

  • You automatically share when accessing this Website;  

  • In email, text, and other electronic messages or communications between you and this Website. 

It does not apply to information: 

  • Collected by CNHA offline or through any other means, including on any other website operated by CNHA or any third-party (including any of our affiliates or partner organizations); or  

  • Collected by any third-party (including any of our affiliates or partner organizations), including through any external application, website, or content (including advertising) that may link to or be accessible from or through the Website.

If you do not agree with our policies and practices, your choice is not to use our Website. By accessing or using this Website, you agree to this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Information You Provide Through the Website 

We collect several types of information from and about users of our Website, from information you may submit when using the website or communication concerning the services provided through the website, such as information submitted through: 

  • Filling in forms on our Website, such as information provided at the time of registering to use our Website, applying for CNHA programs, or requesting further services; 

  • Corresponding with CNHA; 

  • Responding to survey(s) We may ask you to complete for research purposes. 

The types of information collected through such sources may include information: 

  • By which you or members of your household may be personally identified ("personally identifiable information" or “PII”), which may include information such as: names, mailing addresses, email addresses, telephone numbers, social security numbers, birth dates, and any other information by which you may be individually identified, located, or contacted online or offline; 

  • Concerning your need for Program aid (some of which may also be PII), which may include records or information such as: income amounts and sources, employment status, employer name and contact information, tax information, or information concerning applications for aid to and/or aid received from other organizations such as FEMA or the American Red Cross; and 

  • Various types of Demographic information relating to the Program’s or CNHA’s mission; 

We collect this information directly from you when you provide it to us, or from our affiliate or partner organizations where you have authorized or agreed to their sharing of such information. 

Information We Collect Through Automatic Data Collection Technologies   

As you navigate through and interact with our Website, We may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including: 

  • Details of your visits to our Website, including traffic data and other communication data and the resources that you access and use on the Website. 

  • Information about your computer and internet connection, including your IP address, operating system, and browser type. 

The information We collect automatically is only statistical data and does not include PII. It helps us to improve our Website and to deliver a better and more personalized service, including by enabling us to: 

  • Estimate our audience size and usage patterns.

We do not collect personal information automatically, but We may tie this information to PII that We collect from other sources or you provide to us. 

Information Concerning Juvenilles Under the Age of 18 

The Website is not intended for children under 18 years of age, and no one under age 18 may provide any PII via the Website. We do not knowingly collect PII from children under 18. If you are under 18, do not use or provide any information on this Website or through any of its features, register on the Website, use any of the interactive or public comment features of this Website, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use. If We learn We have collected or received personal information from a child under 18 without verification of parental consent, We will delete that information. 

Any PII submitted by an adult concerning a juvenile under the age of 18 for the purposes of applying for and receiving disaster relief assistance from CNHA through the Program shall have only be used for this purpose and will only disclosed to effectuate this purpose or to comply with any court order, law, or legal, administrative, or regulatory process. 

How We Use Your Information 

We may internally use information that We collect about you or that you provide to us, including PII:  

  • To present our Website and its contents to you; 

  • To provide you with information, relief, or services that you request from us; 

  • To provide you with notices about your account and application; 

  • To perform our obligations and enforce our rights under any contracts entered into between you and Us; 

  • To notify you about changes to our Website or any programs or services We offer or provide though it; 

  • For any other purpose We may disclose when, or prior to, you provide the information; and, 

  • To fulfill any other purpose(s) which you may specify or consent to. 

We may also use your information to contact you about our own and partners’ programs and services that may be of help to you. 

Disclosure of Information 

We may, to the extent allowed by law, disclose without restriction:  

  • Any information which is not PII that We have collected or which you have provided;  

  • Any non-PII aggregated information about Website users —including aggregated information that does not itself contain PII or identify any individuals, but is generated by aggregating PII and/or other information; and/or,  

  • Any other non-confidential information that does not identify any individual.  

 

To the extent allowed by law and our agreements with other information sources, We may disclose your PII for limited purposes (which you are hereby provided notice of and, by submitting said information and/or applying for the Program, hereby agree to), which include purposes such as : 

  • Providing you with disaster relief housing assistance through the Program;  

  • Providing you with any other disaster relief aid or assistance you have applied for through CNHA or any of our partner or affiliated governmental or charitable disaster relief organizations. 

  • For any other purpose disclosed by us when, or prior to, you provide the information; 

  • Fulfilling any other purpose(s) which you may, at any time, specify or consent to; 

  • To comply with any court order, law, or legal, administrative, or regulatory process; 

  • To perform any obligation(s) or enforce right(s) We may have under any agreement between you and us, including this Agreement and our Terms of Service, or, for specific limited purposes, under any other agreement(s) we are a party to; and/or, 

  • Where it is determined, in CNHA’s sole discretion, to be in your best interests or the collective best interests of Helping Maui / Kako’o Maui aid recipients, or persons directly impacted by the August 2023 Maui wildfires, as a whole, and that such disclosure is appropriate, reasonable, and reasonably necessary. 

Data Security 

CNHA is committed to maintaining the highest reasonable level of applicable cyber and organizational measures to protect your PII in its custody from accidental loss and from unauthorized access, use, alteration, and disclosure.  To this end, CNHA has adopted policies and best practices for information and cyber security which have been adapted from the National Institute of Standards and Technology (NIST) Special Publication 800-531 and International Organization for Standards (ISO) 270012, among other sources.   

The safety and security of your information also depends on you. Where We have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Website like message boards. The information you share in public areas may be viewed by any user of the Website. 

Unfortunately, the transmission of information via the internet is not completely secure. Although We do our best to protect your personal information, We cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website. 

Changes to Our Privacy Policy 

It is our policy to post any changes We make to our privacy policy on this page.  If We make material changes to how We treat our users' personal information, We will notify you through a notice on the Website home page or by email to the email address specified in your account.  The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring We have an up-to-date active and deliverable email address for you, and for periodically visiting our Website and this privacy policy to check for any changes.
